Valid property-owner signatures covered 2.4% of the land in the protest area, below the 20% needed to trigger a special 10-vote requirement for City Council approval.

Denver planning staff determined that a protest petition challenging the proposed rezoning of 2246 N. Federal Blvd. did not meet the legal threshold. Valid property-owner signatures represented 9,972 square feet, or 2.4% of the land in the 200-foot protest area—below the 20% required to trigger a special requirement for 10 affirmative City Council votes, the city’s review memo says. The calculation is based on land area, not a headcount of signers.
The petition’s result does not decide whether the rezoning will pass. The proposal would change the site’s zoning from G-MX-3, DO-8 to U-MS-5, DO-8. The applicant describes a potential development of about 242 apartments and 9,000 square feet of ground-floor commercial space; those plans are not commitments established by the rezoning application, which describes the proposal.
Denver planning staff recommended approval, and a City Council hearing is scheduled for Oct. 19, 2026, the Council agenda says.
Separately, staff counted 47 people opposed to the rezoning and nine residents in support. The staff report lists 45 support letters from Family Star Montessori staff and board members as a separate category, alongside the public-comment tally. The site, now occupied by Family Star Montessori, is in Jefferson Park.
