Commerce City Council is scheduled to consider authorizing the city manager to negotiate a reimbursement agreement of up to $2,625,094.49 with Clayton Properties Group for roadway and drainage improvements serving Reunion Filings 38, 39 and 40. The Oct. 19 agenda lists the proposal for consideration; no agreement has been approved yet.
The work would cover the west side of Chambers Road between Second Creek drainage and East 112th Avenue, and the south side of East 112th Avenue from Chambers Road to Second Creek drainage, according to the draft resolution. The council communication describes about 1,490 feet of improvements to the south half of East 112th Avenue, drainage piping and water-quality ponds. Some facilities would also manage runoff connected to the Chambers Road widening and future development east of the road.
Staff recommends approval of Resolution 2026-122. The proposed reimbursement would use road and drainage impact fees, with no additional funds requested. The city estimates $1,389,654 in road impact fees from Filings 39 and 40 and $1,574,456 in drainage impact fees from Filings 38, 39 and 40. The communication says the fees are collected through development in the area and Benefit District 2.
If authorized, the city manager would negotiate final pricing and payment terms. Any reimbursement would depend on a written contract acceptable to the city and approved as to form by the city attorney. The communication estimates construction could begin in fall 2026 and take 24 months from its start.
