Arapahoe County draft would assign all CORE line relocation costs to county

The draft assigns design, financing and construction costs to the county. Staff estimated the move at about $2 million and described a separate 50-50 county-Aurora funding arrangement.

Arapahoe County’s draft agreement would make the county responsible for all costs to move CORE Electric Cooperative’s transmission line across Planning Area O, from an easement on the property’s east side to new easements along its western and northern boundaries. The roughly 25.9-acre area lies between E-470 and South Gun Club Road, where the line must be relocated before the road can be widened, the draft agreement says.

The county would pay to design, finance and carry out the relocation. The draft says the property owner, Copperleaf Metropolitan District No. 7, developers and Planning Area O would have no financial responsibility for that work.

County staff estimated the relocation at about $2 million and described it as previously funded through a 50-50 county-Aurora split, with the funds held by Aurora, a Sept. 28 county board report says. The draft does not explain how that reported cost-sharing arrangement relates to assigning all relocation costs to the county.

The draft calls for the county to use best efforts to coordinate construction to begin within 18 months of the agreement’s effective date and finish within 30 months. Those targets are aspirational: the draft says delays would not constitute a breach or allow damages claims.

The relocation must happen before the Gun Club Road widening, but the draft does not set the road project’s schedule. At a Sept. 28 briefing, county staff said the widening was not bound to the relocation’s 18- and 30-month targets and that road construction funding was still pending, staff told commissioners. The draft also says the status of the relocation or other Gun Club Road work cannot be used to condition, delay or deny Planning Area O development applications.
