Denver council approves transfer of trash contract to 5280 Waste Solutions

Denver City Council approved an assignment Sept. 21 making 5280 Waste Solutions LLC the contractor for the city’s trash-removal and disposal work, replacing BDKC Holdings LLC as the contracting entity. The agreement keeps the contract’s $7 million capacity and extends its term through Nov. 30, 2028.

The change follows a corporate transaction rather than a documented change in the city’s trash-collection scope. The assignment and amendment agreement says BDKC was formerly known as 5280 Waste Solutions LLC, while 5280 Waste Solutions LLC was formerly known as 5280 Waste Solutions Holdings LLC. It says 5280 purchased all of BDKC’s assets on or about May 1, 2025.

Under the agreement, 5280 assumes the contract’s rights, obligations and liabilities, while BDKC stops performing services or receiving benefits under the agreement. The contract covers trash pickup and disposal from city facilities, along with dumpsters and 55-gallon barrels at designated Denver Mountain Parks locations.

The city’s contract request lists $7 million as the current and total contract amount, with no additional funds requested. It describes the amendment as a two-year extension and says all other terms and conditions will remain the same. The agreement also adds compliance requirements, when applicable, under Denver’s minimum-wage and civil-wage-theft ordinances.

The resolution received Finance and Business Committee approval by consent Sept. 8 and a Mayor-Council review date of Sept. 15. On Sept. 21, it was included in a block motion after being called out for council comments; 11 council members voted yes. The filed resolution says the agreement is not effective or binding on Denver until it is fully executed by the required city signatories and, if required by the City Charter, approved by the council.
